TERMS OF SERVICE

It is the responsibility of the purchaser to ensure that all players understand the Terms of Service.

 

CANCELLATIONS

You have up to two weeks before a booking date to cancel or reschedule your booking. We do not accept last-minute cancellations.

If you have any issues with your booking leading up to your session, contact your venue.

Bookings can only be canceled at the discretion of Zero Latency PTY LTD. Canceled tickets will be credited to the purchaser’s Zero Latency account.

 

REFUND & RETURNS

We do not issue refunds for cancellations, a change of mind or gift vouchers.

Please contact your venue if you are not satisfied with your purchase so that we can resolve any problems.

A refund fee may apply.

 

LATE ARRIVAL

Sessions are booked back-to-back so you must arrive on time. We recommend that you arrive 10 minutes early to check in and commence your experience on time. If you are a Zero Latency VR player and members of your booking are late, the following process will apply:

Split Team – When you haven’t booked the whole session

If you are part of a split team, we will start the safety briefing on time for all those in attendance. Due to strict time constraints, if the Game Master has started the suit-up process by the time you arrive for your session, we cannot allow you to join.

Whole Team – When all players in the session are your friends

If one of the members of your group is late, you have two options:

  •       You can start the experience without them but if they do not arrive before you start the experience, they cannot join
  •       You can wait for them to arrive but your in-game play will be cut short
  •       If you arrive late you will not receive a credit or refund

 

CHILDREN UNATTENDED

Children are not to be left unattended in the waiting area as Zero Latency staff members are not responsible for the safety or care of children.

If there is no one to supervise your child, you will be unable to enter the experience. You will not receive a credit or refund.

 

GIFT VOUCHERS

  •     Gift Vouchers can only be redeemed at the venue location it has been purchased for, and cannot be transferred to a different venue location.
  •     Gift Voucher validity is set by the venue location that sells them, confirmed via email after purchase, and cannot be extended beyond that date.
  •     Gift Vouchers are to be treated as cash and cannot be refunded and/or replaced if lost, stolen, previously printed and used, or damaged.
  •     Gift Vouchers cannot be exchanged for cash, sold, or used to purchase Gift Vouchers.
  •     Gift Vouchers are released to the purchaser or recipient via email but they can be printed, reprinted, or emailed as required.
  •     Gift Voucher codes are unique and can be used repeatedly and transferred to another customer for use until the value has been redeemed.
  •     Any outstanding balance will be retained on the same Gift Voucher code which can be used until the value has been redeemed.
  •     Gift Vouchers can be used for standard session/s ticket/s.
  •     Gift Vouchers must be redeemed online at www.zerolatencyvr.com.

 

PROMOTION CODES

These terms and conditions apply to promotions where you must redeem a promotion code to obtain the promotional offer:

  •     To apply the promotion code, you must enter it prior to completing the order.
  •     The promotion code cannot be applied to previously placed orders.
  •     The promotion code is valid for a limited time only and cannot be extended past its expiry date
  •     Promotion codes are valid for online bookings only.
  •     Promotion codes cannot be used to purchase gift vouchers. 
  •     Each promotion code can be used only once unless otherwise specified.
  •     Each promotion code applies only to qualifying package bookings if specified in the offer.
  •     The promotion is subject to all restrictions set forth in the offer.
  •     The promotion code is not transferable or redeemable for cash or credit.
  •     If you cancel a booking purchased using a promotion code and are eligible for a refund, we will subtract the value of the promotion code from your returned store credit. 
  •     Promotion codes may not be combined with other offers.
  •     The validity of the promotion code can be changed by Zero Latency at any time, without warning.
  •     If you violate any of the Terms and Conditions, the promotion will be invalid, and the promotion code discount will not apply.

 

PRIVATE EVENTS

  •     All players must arrive at the specified start time unless otherwise discussed with the Event Coordinator.
  •     The initial 30 minutes of the event is allocated to player sign-in, game briefing, and suit-up. Your Event Coordinator will advise your expected event duration based on your event packages and add-ons.
  •     The Event Host reserves the right to alter the game selection and/or duration to ensure the event concludes at the specified finish time.
  •     Delays to the event due to late arrivals or absent players may result in some players being unable to participate.
  •     Bookings with more than 14 days notice have 7-day payment terms.
  •     Bookings with less than 14 days notice require full upfront payment.
  •     Bookings must be paid in full before the event date, and can be paid by credit card using the online payment portal, or by bank transfer.
  •     Booking changes or cancellations can be made up to the number of days before the event date, as specified by the venue.
  •     Booking cancellations within 7 days of the event date will incur a 20% cancellation fee.
  •     On-the-day cancellations or no-shows will forfeit the full value of the event booking.
  •     Event packages are available as specified on the booking system. Please contact your Event Coordinator for booking options outside of these times.
  •     Any unused player slots from an event cannot be credited or refunded.
  •     Promotional codes are not valid for event bookings unless specified.

1.

SARAMU Enterprises inc. d/b/a Zero Latency Irving , as the supplier of virtual reality simulation services, sells all tickets and supplies all virtual reality simulation services and facilities to you (the customer) including, but not limited to gaming, simulation walk throughs, training exercises, use of motion capture and tracking technology, use of wearable computing technology, use of wireless controllers, use of haptic feedback technology, use of head mounted virtual reality displays, use of free roam untethered virtual reality simulation technology and equipment, recreation and waiting areas, equipment rental and maintenance, use of tracking spaces and the presence of people and objects therein, the surrounding areas and any other associated activities, hereby known as the simulation activities in the SARAMU Enterprises inc. venue located at 2448 Irving Mall, Irving, Texas, 75062 subject to the following conditions:

 

1.1.

By purchasing a ticket for or by using  the facilities at SARAMU Enterprises inc. d/b/a Zero Latency Irving venue located at 2448 Irving Mall, Irving, Texas 75062, the customer agrees to be bound by these conditions.

 

1.2.

SARAMU Enterprises inc., d/b/a Zero Latency Irving  its licensors, its employees, directors and agents are not liable to the customer, your dependants or legal representatives for personal injury or death suffered by the customer because the simulation activities were not supplied with due care and skill or were not reasonably fit for their purpose or because of the negligence, breach of contract, statute or statutory duty by SARAMU Enterprises inc.d/b/a Zero Latency Irving  venue located at 2448 Irving Mall, Irving, Texas, 75062.

1.3.

RISK WARNING: The use of tracking spaces, head mounted virtual reality displays, free roam untethered virtual reality simulation technology and equipment or any other equipment and technology at  SARAMU Enterprises inc. venue located at 2448 Irving Mall, Irving, Texas 75062, involves a significant risk of Customers suffering personal injury including the possibility of serious injuries, permanent disability or death. All Customers who engage in such simulation activities do so at their own risk. The customer acknowledges that the simulation activities are dangerous with many inherent risks and hazards and as a consequence assumes and accepts all such risks and hereby waives the right to sue SARAMU Enterprises inc. d/b/a Zero Latency Irving  and its licensors for any personal injury or death in any way whatsoever caused by or relating to the customer’s participation in such activities.

 

1.4.RELEASE OPERATOR, and its successors, assigns, subsidiaries, managers, members, affiliates, officers, directors, employees, agents, landlords, sponsors, independent contractors, and owners of the facilities (“Owners”) from, and not to sue them on account of or in connection with any claims, causes of action, injuries, damages, costs or expenses arising out of Participant’s use of or presence upon the Facilities, including without limitation, those based on death, bodily injury, or property damage, whether or not caused by the negligence, gross negligence, or other fault of Operator or any other person, including, but not limited to, strict product liability or any other liability without fault; 

 

1.5.

WAIVE the protection afforded by any statute or law in any jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to the claims, material or otherwise, which the person giving the release does not know or suspect to exist at the time or executing the release.

 

1.6.

The customer agrees to pay the cost of and authorises SARAMU Enterprises inc. d/b/a Zero Latency Irving.  to take all steps it considers reasonably necessary to protect his/her welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation.

 

1.7.

If the person playing is less than 18 years of age, this waiver must be co-signed by a parent or guardian. Customers of 15 years of age or under must be accompanied by a parent or guardian to use the facilities atSARAMU Enterprises inc. d/b/a Zero Latency Irving venue loacted at 2448 Irving Mall, Irving, Texas, 75062.  In all circumstances listed above, the parent or guardian agrees to be bound by the conditions in the liability waiver on behalf of the minor.

 

1.8.

Customers agree they are in good health and free from any adverse medical conditions. For safety reasons, pregnant women, customers with pre-existing health issues such as epilepsy, heart conditions, fractured or broken limbs, severe hearing loss, or require the use of a wheelchair or other assisted mobility devices are not permitted to use tracking spaces, head mounted virtual reality displays, free roam untethered virtual reality simulation technology and equipment or any other equipment. SARAMU Enterprises inc. d/b/a Zero Latency Irving can not and does not provide medical advice therefore if in doubt, please seek professional medical advice.

 

1.9.

While in SARAMU Enterprises inc. d/b/a Zero Latency Irving venue loacted at 2448 Irving Mall, Irving, Texas, 75062, you consent to images and video being taken for security or promotional purposes of yourself, your children or of children for whom you are responsible.

 

1.10.

Customers must comply with all signs or other directions ofSARAMU Enterprises inc. d/b/a Zero Latency Irving and it may suspend or cancel the customer’s and a participant’s access to simulation activities at any SARAMU Enterprises inc. d/b/a Zero Latency Irving venue located at 2448 Irving Mall, Irving. Texas, 75062 in its absolute discretion for non-compliance with these conditions, or for reckless or careless conduct.

 

1.11.

Customers must not be under the influence of drugs or alcohol as failure to comply may result in SARAMU Enterprises inc. d/b/a Zero Latency Irving suspending or cancelling the customer’s access to simulation activities at any SARAMU Enterprises inc. d/b/a Zero Latency Irving venue located at 2448 Irving Mall, Irving. Texas, 75062.

 

1.12.

If you purchase a ticket for the use of the tracking spaces, head mounted virtual reality displays, free roam untethered virtual reality simulation technology and equipment or any other equipment or facilities at any SARAMU Enterprises inc. d/b/a Zero Latency Irving venue located at 2448 Irving Mall, Irving. Texas, 75062, on behalf of another person, you and that other person both agree that you make that purchase as the authorised agent of that other person so that he/she will be bound by these conditions.
